Terms of Service

By installing, accessing, or using the Note Pierce browser extension (“the Extension”), you agree to these Terms of Service (“Terms”). If you do not agree, do not install or use the Extension.

Note Pierce is an ear-training extension for musicians. It presents drills for intervals, chord quality, scales, cadences, inversions, and rhythm, with a mastery-based level ladder, spaced review, weak-spot practice, custom drills, progress statistics, optional practice reminders, and a choice of synthesized voices or guitar recordings. It runs in the browser side panel or popup.

Your progress and settings are stored on your own device, as described in our Privacy Policy. The Extension does not use your microphone and does not read the pages you browse.

You must be at least 13 years old to use Note Pierce. If you are under the age of majority where you live, use it only with permission from a parent or legal guardian.

We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Extension for personal practice or internal professional teaching use on devices you own or control, subject to these Terms. Note Pierce is licensed, not sold, and we retain all rights not expressly granted here.

You may not:

• Copy, modify, distribute, sell, sublicense, or lease any part of the Extension
• Reverse engineer or attempt to extract the source code, except where applicable law allows it despite this restriction
• Circumvent, disable, or tamper with the Pro entitlement check, or share, resell, or publish a means of doing so
• Use the Extension for any unlawful purpose
• Remove or alter any proprietary notices or labels

The Extension, including its design, code, interface, drill content, and documentation, is owned by Crescendo Companion and protected by applicable intellectual property laws. The guitar recordings bundled with the Extension are the developer's own performances and are licensed to you only as part of the Extension; they may not be extracted, redistributed, or used in other works. These Terms grant you no ownership rights.

The Extension includes one third-party library, the ExtensionPay client, licensed under the GNU Lesser General Public License v3.0, which itself bundles Mozilla's webextension-polyfill under the Mozilla Public License 2.0. Those components stay under their own licences, not these Terms. The full notices, the licence texts, and the corresponding source ship inside the extension package as THIRD_PARTY_NOTICES.txt and the third_party/ folder.

The free tier includes the first three levels of every one of the six modules, climbed by mastery, along with the four synthesized voices, practice streaks, keyboard shortcuts, per-level accuracy, auto-advance, and A4 calibration.

Pro is a one-time purchase that unlocks every level of all six modules, playable in any order rather than only the next rung, plus Custom drill, Review mode, Weak spots, and the guitar recordings. There is no separate free trial: the free levels serve that purpose.

Free and Pro feature lists may change as the Extension develops. What applies to your purchase is the split published at the time you bought.

Pro is processed by ExtensionPay, which uses Stripe. By purchasing, you also agree to ExtensionPay's and Stripe's terms of service. Pro access is verified through ExtensionPay and is tied to the email address you give it, not to your browser profile or Google account.

Note Pierce Pro is a one-time payment, not a subscription. All payment processing is handled by ExtensionPay and Stripe; we do not store or process payment information directly. Prices may change with reasonable notice, and may exclude taxes, fees, or currency-conversion charges applied by payment processors or banks.

Because Pro is a one-time purchase of digital content unlocked immediately, purchases are generally final once payment completes. The free levels of every module exist so you can evaluate the Extension before paying.

We may issue refunds for duplicate charges, billing errors, or serious technical problems at our discretion. Except where required by applicable law, refunds are not provided solely because a browser, device, or operating system changes in a way that limits the Extension. To request a refund, email us within 14 days of purchase with your purchase email.

Note Pierce depends on browser extension APIs and on Web Audio support in your browser. Browsers may change their code, policies, or technical restrictions at any time. We do not guarantee that Note Pierce will remain compatible with any particular browser version, operating system, or device, and we may modify, suspend, replace, or discontinue parts of it to fix bugs, improve security, or comply with legal or store requirements.

THE EXTENSION IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Extension will be uninterrupted or error-free, and we make no guarantee about any particular musical or educational result. Note Pierce is a practice tool, not instruction, certification, or assessment. Listen at a comfortable volume; you are responsible for your own hearing safety and for the output level of your device and headphones.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL CRESCENDO COMPANION, ITS DEVELOPERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use of or inability to use the Extension
• Loss of practice progress stored in your browser profile
• Any unauthorized access to or alteration of your data
• Any interruption, removal, restriction, or cessation of the Extension's functionality

Our total liability for any claim relating to the Extension will not exceed the amount you paid for it.

You agree to indemnify, defend, and hold harmless Crescendo Companion and its developers from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use or misuse of the Extension; (b) your violation of these Terms; or (c) your violation of any applicable law or third-party right.

Note Pierce is not affiliated with, endorsed by, or sponsored by Google, the Chrome Web Store, Mozilla, Microsoft, or any other third party. All product names, logos, and trademarks belong to their respective owners and are referenced only to describe compatibility.

Your use of Note Pierce is also covered by our Privacy Policy, which explains local storage, reminders, payment-provider handling, support emails, and deletion options.

We may suspend or terminate your access to the Extension, including Pro features, for breach of these Terms. On termination your license is revoked and you must uninstall the Extension. Provisions that by their nature should survive termination, including warranty disclaimers, limitation of liability, indemnification, and governing law, will survive.

We may modify these Terms at any time. Changes are reflected by updating the “Last updated” date above. Continued use of the Extension after a change constitutes acceptance of the updated Terms.

These Terms are governed by the laws of the United States of America, without regard to conflict of law provisions. Before starting any formal legal action, you agree to contact us and attempt to resolve the issue through negotiation. If that fails, the matter may be submitted to a court of competent jurisdiction.
